Higher Education Gender-based Violence Code

Australia has introduced the National Higher Education Code to Prevent and Respond to Gender-based Violence, a mandatory legislative framework passed in 2025, requiring universities and higher education providers to implement comprehensive standards for safety, prevention, and support, covering governance, environments, training, support services, processes, data, and student accommodation to tackle sexual harassment and violence on campuses. This Code establishes accountability, drives cultural change, and ensures consistent, high-quality responses for staff and students, with compliance linked to Commonwealth funding.

Key Aspects of the National Code

Mandatory Standards

Defines seven core areas for providers to address: Accountable leadership, Safe environments, Knowledge & capability, Safety & support, Safe processes, Data & evidence, and Safe Student Accommodation.

Whole-of-Organisation Approach

Requires universities to integrate these standards across all operations, including off-campus activities, placements, and digital spaces.

Accountability & Enforcement

Compliance is tied to funding through the Higher Education Support Act 2003 (HESA), with powers for the Department to take action, including legal remedies for non-compliance.

Focus on Prevention & Response

Mandates evidence-based prevention education and training for staff and students, alongside improved support and reporting mechanisms for victim-survivors.

Student Accommodation

Extends requirements to university-controlled or affiliated student housing.

Implementation

The Code became law through the Universities Accord Bill 2025, with implementation expected to roll out, aiming for baseline compliance by early 2026.

Purpose

To ensure a consistent, high standard of safety across the sector, drive cultural change, and hold providers accountable for creating safe environments free from gender-based violence.
